Can an out-of-state employer need North Dakota WSI coverage? 

Yes. If you come into North Dakota and hire workers here for work here, coverage is required. WSI also applies significant-contact tests, including whether a worker earns 25 percent or more of their gross annual wage for services in the state, or whether 25 percent of your payroll is payable for North Dakota services.
